Professor Bola Akinterinwa argued that Section 134(2)(b) of the Nigerian Constitution requires a presidential candidate to secure 25% of votes in Abuja, interpreting the FCT as a mandatory, distinct hurdle rather than just a 37th state. Despite this, the Supreme Court ruled that a 25% threshold in the FCT is not required to win, provided the candidate meets the 25% requirement in two-thirds of the states.
